The site lemarcheduvelo.com is the property of the Company lemarcheduvelo SARL in its entirety, as well as all the rights relating thereto.

Any reproduction, in whole or in part, is systematically subject to the authorization of the owners. However, links of the hypertext type to the site are authorized without specific requests.

1. Acceptance of Terms

The customer acknowledges having read, at the time of placing the order, the special conditions of sale set out on this screen and expressly declares to accept them without reservation. These general conditions of sale govern the contractual relationship between lemarcheduvelo and its customer, both parties accepting them without reservation. These general conditions of sale will prevail over all other conditions appearing in any other document, except prior, express and written derogation.

2. Availability of products

The majority of the products offered to its customers by lemarcheduvelo are available in our warehouse, if there is a remainder, the customer will be notified within 48h/72h of the new delivery time.

3. Orders

lemarcheduvelo confirms the acceptance of his order to the customer at the email address that he will have communicated. The sale will only be concluded once the order has been confirmed. lemarcheduvelo reserves the right to cancel any order from a customer with whom there is a dispute relating to the payment of a previous order. Lemarcheduvelo reserves the right to cancel any order from a customer if the product ordered is no longer available following a stock error, for example if the same product was sold at the same time directly in store, the customer will then be notified by email within 48 hours. The information given by the buyer, when taking the order, commits him: in the event of an error in the wording of the recipient's contact details, the seller cannot be held responsible for the impossibility in which it could be to deliver the product.


4. Deliveries and withdrawal period

After confirmation of the order, lemarcheduvelo undertakes to deliver to its carrier all the references ordered by the buyer within one to twenty working days, subject to the availability of the article. This carrier undertakes by contract with lemarcheduvelo to deliver the order to the buyer's address provided by lemarcheduvelo. Attention before refusing any delivery you must first contact the company lemarcheduvelo, otherwise the shipping costs will be charged to you.

In addition, for deliveries outside mainland France, the customer agrees to pay all taxes due on the importation of products, customs duty, value added tax, and all other taxes due under the laws of the country of receipt of order. Lemarchéduvélo is released from all legal responsibilities if the payment of taxes was not made by the customer. Delivery is made in the time slot from 8 a.m. to 6 p.m. to the address indicated by the customer, or in the event of absence, to another person authorized by the customer. Any delays do not entitle the buyer to claim damages. Deliveries in the countries of the EEC are made by colissimo followed Europe or world according to the choice of the customer. In the case of a technical product, the customer will take particular care to check the proper functioning of the device delivered, to read the instructions for use provided to him. In the event of apparent defects, the buyer has the right of return under the conditions provided for in this document. War, riots, fire, strikes, accidents and the impossibility of being supplied are considered as cases of force majeure releasing the seller from his obligation to deliver. Always check your package upon arrival. You have a period of 24 hours to make any reservations with our customer service to report any damage related to transport. In accordance with Article L. 221-15 of the Consumer Code, lemarcheduvelo.com will contact the carrier to resolve any problem related to transport. In accordance with Article L. 216-4 of the Consumer Code, any risk of loss or damage to goods is transferred to the consumer when the latter or a third party designated by him, and other than the carrier proposed by the professional, takes physical possession of these goods. After this period, no claim related to a transport problem can be accepted. For reasons of availability, an order may be delivered in several installments to the customer. The customer only pays for one delivery. If the customer wants 2 delivery locations, he places 2 orders, with the related delivery costs.

You have a period of 14 working days to return your items if they were not suitable, in their original packaging and without any trace of use so that they can be put back on sale. In case of exercising the right of withdrawal, the return costs remain your responsibility.

In the event of exercise of the right of withdrawal, the company lemarcheduvelo is required to reimburse the sums paid by the customer, free of charge. The refund is due within a maximum period of 14 days. Refunds are made by check, bank transfer, credit card or by Paypal if you have used their services.

Regarding bicycle deliveries, some parts may require assembly on your part, by means of this article you therefore accept the conditions. In general, the assembly comes down to: front wheel, handlebars/handlebars and pedals. Verification of the assembly by a cycle professional is compulsory for France before using your new bike.

Regarding the delivery of hazardous materials (Lithium batteries): these items are sent in accordance with strict preparation and routing rules related to the dangerousness of the product. In the event of the return of a product containing a hazardous material, the customer will ensure compliance with the rules relating to the shipment of this type of product.

5. Rates

The price is expressed in euros. The price indicated on the product sheets does not include transport except in the case where this is specified. The price indicated in the order confirmation is the final price, expressed inclusive of all taxes and including VAT for France and the countries of the EEC. This price includes the price of the products, the costs of handling, packaging and storage of the products, the costs of transport and commissioning. Transport costs can be consulted at any time in your basket. The price for countries outside the EEC are indicated in euros excluding taxes.

6. Payments

The price invoiced to the customer is the price indicated on the order confirmation sent by lemarcheduvelo. The price of the products is payable in cash on the day of the actual order. The order validated by the customer will only be considered effective when the payment has reached us. In the event of refusal or absence of payment, the order will be automatically canceled and the customer notified by e-mail. Furthermore, lemarcheduvelo reserves the right to refuse any order from a customer with whom there is a dispute. The goods remain the property of lemarcheduvelo until full payment has been made.

In accordance with the Data Protection Act of January 6, 1978, you have, at any time, a right of access, rectification, and opposition to all of your personal data by writing, by mail and by justifying your identity, at  Le Marché du Vélo, "Les Balcons de L'Arly" Tour PGB, 2 Place Léontine Vibert - 73200 ALBERTVILLE - FRANCE.

7. Disputes

This contract is subject to French law. lemarcheduvelo cannot be held responsible for damages of any kind, whether material, immaterial or bodily, which could result from a malfunction or misuse of the products marketed. The same applies to any modifications to the products resulting from the manufacturers. The liability of lemarcheduvelo will, in any case, be limited to the amount of the order and cannot be blamed for simple errors or omissions which may have remained despite all the precautions taken in the presentation of the products. In the event of difficulties in the application of this contract, the buyer has the possibility, before any legal action, to seek an amicable solution, in particular with the help of: a professional association in the branch, an association of consumers or any other counsel of his choice. It is recalled that the search for an amicable solution does not interrupt the "brief period" of the legal guarantee, nor the duration of the contractual guarantee. It is recalled that as a general rule and subject to the judgment of the Courts, compliance with the provisions of this contract relating to the contractual guarantee assumes that the buyer honors his financial commitments to the seller. Complaints or disputes will always be received with attentive benevolence, good faith being always presumed in those who take the trouble to explain their situations. In the event of a dispute, the customer will first contact the company to obtain an amicable solution. In accordance with Article L.612-1 of the Consumer Code, the consumer may have free recourse to a consumer mediator. In the absence of an amicable solution, the Customer may contact the Medicys Mediator free of charge (73 boulevard de Clichy, 75009 Paris, see the site https://www.medicys.fr/).

8. Warranties


When acting as a legal guarantee of conformity, the consumer:

- has a period of two years from delivery of the property to act;
- can choose between the repair or the replacement of the good, subject to the conditions of cost envisaged by the article L. 217-9 of the code of consumption;
- is exempted from providing proof of the existence of the lack of conformity of the goods during the six months following the delivery of the goods. This period is extended to twenty-four months from March 18, 2016, except for second-hand goods.
The legal guarantee applies independently of any commercial guarantee granted.

Finally, the consumer can decide to implement the guarantee against hidden defects of the thing sold within the meaning of article 1641 of the civil code and that in this case, he can choose between the resolution of the sale or a reduction of the selling price. in accordance with article 1644 of the civil code.

This warranty does not cover equipment used in competition or rental, damage related to wear and tear, misuse, lack or lack of maintenance, and any modifications...

Not included in the warranty:

- replacement of so-called consumable products (tyres, chain, cassette, batteries, etc.).

- non-compliant, irregular and abnormal use of the products.

- the defects or specificities of a product being the subject of a mention in the article sheets.

- the defects and their consequences related to the use not conforming to the use for which the product is intended

Note that the legal warranty may be extended by a commercial warranty (offered either by Le Marché du Vélo or by the manufacturer). When the commercial guarantee extends the legal guarantee, the information is indicated on the product sheet.

The products must be returned to the address indicated by the after-sales service.

All returns of defective parts are made under the responsibility of the customer, the return costs are then reimbursed if the defect is noted by our after-sales service. Any incomplete or partial return cannot be taken as a guarantee. Any traces of modifications or dismantling will result in the total cancellation of the warranty.

All returns must be made within a maximum of 7 working days after acceptance by the after-sales service.
The bikes we sell are delivered pre-assembled in a box. It is essential that the final assembly of the bike be done by a cycle professional or by a person with sufficient knowledge to do so. Bikes delivered in store are also delivered pre-assembled in a cardboard box. Any assembly or adjustment by one of our partner stores will be invoiced to you by them.

In all cases lemarcheduvelo cannot be held responsible for non-compliance with the regulations and laws in force in the country of receipt, the liability of lemarcheduvelo is systematically limited to the value of the product in question, value on its date of sale and this without any possibility of recourse against the brand or the company producing the product. In any case, the customer benefits from the legal guarantee of eviction and hidden defects (Art.1625 and following of the Civil Code). On condition that the buyer proves the hidden defect, the seller must legally repair all the consequences (art. 1641 and following of the civil code); if the buyer goes to court, he must do so within a "short time" from the discovery of the hidden defect (art. 1648 of the civil code).
